DA says Mkhwebane needs to go

The Democratic Alliance on Tuesday announced that it will be requesting that removal proceedings against Public Protector Busisiwe Mkhwebane be urgently initiated.

Glynnis Breytenbach, DA Shadow Minister of Justice and Constitutional Development, on Tuesday released a statement saying that the party would be acting on its doubts in the Public Protector by writing to the Speaker of Parliament, Baleka Mbete, and requesting that Parliament's relevant Portfolio committee deal with the matter in terms of Rule 337 and 338 of the National Assembly Rules.

"The DA has, from the get go, had serious doubts as to Mkhwebane’s suitability for the vital role of Public Protector. She has confirmed these doubts numerous times," Breytenbach said.

Among the incidents which confirmed the DA's doubts, Breytenbach pointed out Mkhwebane's failure to act when President Jacob Zuma tried to interdict the release of the State Capture report last year; her decision to lay criminal charges against her predecessor, Advocate Thuli Madonsela, for releasing the transcript of her interview with the president (which the DA viewed as jumping to the president's defence); her decision to wait for months before acting on key Gupta-related investigations and admitting to overstepping her bounds with her recommendation that the South African Reserve Bank's Constitutional mandate be changed, which the DA says showed a very poor understanding of her own powers and the limits governing them.

"The Public Protector is Constitutionally mandated to investigate misconduct by government departments and entities and to protect the public’s interest," Breytenbach said.

"Clearly, Mkhwebane is acting in the interest of the already captured Number 1 and must be removed before she is allowed to compromise the once proud office any further."
